Insomniac Games has no obligation to monitor the online facilities provided on this Site. However, Insomniac Games reserves the right to review
materials and to remove, and if Insomniac Games deems appropriate, turn over to law enforcement officials, any material, including messages, email, or
online data, that is in violation of the Terms. Insomniac Games reserves the right at all times to disclose any information as necessary to satisfy
any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole
or in part, in Insomniac Game's sole discretion. You are advised to use caution when giving out any personally identifying information. (SEE INSOMNIAC

and use in accordance with these Terms, and for no other purpose, provided that you keep intact all copyright and other proprietary notices. All
Software is owned by Insomniac Games and/or its suppliers and is protected by copyright laws and international treaty provisions. Any reproduction or
redistribution of the Software is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to
the maximum extent possible. WITHOUT LIMITING THE FOREGOING, COPYING OR REPRODUCTION OF THE SOFTWARE TO ANY OTHER SERVER OR LOCATION FOR FURTHER

Applicable law may not allow the disclaimer or exclusion of implied warranties or of incidental or consequential damages, so the above disclaimers and

You hereby agree to indemnify and hold harmless INSOMNIAC GAMES, its affiliates, officers, directors, agents, and employees, from any expense, loss,
claim, damage, fine, penalty or liability, including reasonable fees for attorneys and other professionals, payable under any judgment, verdict, court
order or settlement, to the extent resulting from any claim, demand, action, suit, arbitration, or other proceeding initiated by any third party,
including the assessment, claim or demand by a governmental agency or entity, arising out of your breach of this Agreement.
This agreement is governed by the laws of the State of California, U.S.A. You hereby consent to the exclusive jurisdiction and venue of courts in
Los Angeles County, California, U.S.A. in all disputes arising out of or relating to the Agreement or your use of this Site. You agree that no joint
venture, partnership, employment, or agency relationship exists between you and Insomniac Games as a result of this Agreement or use of this Site. If
any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty
disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable
provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. Unless otherwise
specified herein, this Agreement constitutes the entire agreement between you and Insomniac Games with respect to this Site. It supersedes all prior or
contemporaneous communications and proposals, whether electronic, oral or written, between you and Insomniac Games with respect to the Agreement. A
printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon
or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and
maintained in printed form.
